On October 28, 2022, the U.S. Court of Appeals for the Fourth Circuit vacated a district court judgment and remanded for reconsideration in light of intervening Supreme Court precedent. This outcome was a victory for WLF, which filed an amicus brief in the case. As WLF’s brief showed, the District Court’s decision was inconsistent with the Supreme Court’s recent TransUnion decision. There, the Court said that allowing uninjured class members to maintain suit in federal court violates core separation-of-powers principles.
