Despite their popularity with the plaintiffs’ bar, cy pres awards were never intended for class actions. Recent federal court opinions and a statement by Chief Justice Roberts reflect the judiciary’s willingness to more closely examine the legitimacy of these awards, and skepticism fueled by the abuses of cy pres may perhaps soon spell the end of this practice.
