In Re: New York City Asbestos Litigation
On March 22, 2018, the Supreme Court of New York’s Appellate Division rejected a challenge to a New York City Asbestos Litigation (NYCAL) case management order (CMO) that, WLF argued, deprives asbestos defendants of statutory and due process rights without their consent. Among other things, that June 2017 CMO holds that punitive damages awards are no longer deferred for cases placed on the trial calendar after the CMO’s effective date. The decision was a setback for WLF, which joined other civil-justice groups to file a brief in the case arguing that the CMO improperly jettisons a longstanding practice adopted to protect defendant resources and ensure adequate and timely compensation for sick claimants. The appeals court also declined WLF’s invitation to modify the CMO to include meaningful trust-claim transparency requirements.
