On July 28, 2010, the U.S. District Court for the District of Arizona issued a preliminary injunction against enforcement of all major provisions of SB 1070, the recently adopted Arizona statute that seeks to crack down on illegal immigrants living within the State. The decision was a setback for WLF, which filed a brief urging that the law be upheld. Agreeing with arguments asserted by the plaintiffs, the court held that SB 1070 conflicts with the purposes of federal immigration law – and thus is impliedly preempted by federal law. The court did not reach other constitutional claims in this and related challenges to the statute, including claims that it was likely to lead to racial discrimination against individuals of Hispanic origin. WLF filed its brief on behalf of a coalition that included Members of Congress and Arizona legislators who sponsored SB 1070. Arizona has appealed the decision to the federal appeals court, and WLF has pledged to file a brief in support of the appeal.
