On October 18, 2007, WLF filed a brief in the United States District Court for the Southern District of Indiana in Indianapolis urging the Court to reject a recommendation by the U.S. Attorney to sentence a small business owner to prison for over six years. WLF urged the court to impose probation instead for this first offender found guilty of a minor Clean Water Act reporting offense where there was no showing of any environmental harm. In particular, WLF argued that the advisory Sentencing Guidelines are fatally flawed and should be ignored. WLF further argued that regulatory offenses such as these should be addressed by administrative and civil remedies rather than by unfair criminal prosecution and harsh prison sentences.
