On October 25, 2006, WLF filed a brief in the U.S. Court of Appeals for the Sixth Circuit urging the court to reverse an unprecedented ruling this summer by U.S. District Court Judge Anna Diggs Taylor who agreed with the ACLU and ruled that the Terrorist Surveillance Program (TSP) initiated by the National Security Agency (NSA) shortly after the terrorist attack on September 11, 2001 violated the First and Fourth Amendments, the Foreign Intelligence Surveillance Act (FISA), and the separation of powers. TSP allows electronic surveillance without a court order of certain international communications where one of the parties to the communication is a suspected al Qaeda agent. WLF argued that to the extent that FISA interferes with the President’s authority and duty to protect the country from attack, FISA violates the separation of powers.
